Faraid



It is known that Faraid is Islamic way of distributing ones wealth. I have always wanted to know more about this matter as it is really recommended. There is even a hadeeth about this matter. Anway from my casual reading on this topic didn’t grant me any understanding of the concept or formula used. This blog shows and explain the method of Faraid in a simple manner that I think I’ve got the grab of it. Alhamdulillah. So im writing it so that I will not forget and just incase I need it, ill know where to dig more.

The dalil on the matter is to be found in surah An’nisa 11-12 and 176



Allah menetapkan waris-waris yang berhak mendapat pusaka dan bagaimana seseorang boleh mewarisi. Ayat tersebut juga menjelaskan bahagian atau pecahan yang diwarisi oleh setiap waris yang berhak. Secara ringkasnya, waris utama yang berhak ialah ibu, bapa, suami, isteri, anak lelaki dan anak perempuan. Kaum kerabat yang lain seperti datuk, nenek, bapa saudara, ibu saudara, saudara kandung lelaki dan perempuan boleh mewarisi dengan syarat-syarat tertentu. Terdapat dua kategori waris iaitu Waris Fardhu dan Waris 'Asabah.


Waris Fardhu ialah waris yang disebutkan berhak mewarisi secara terus dan bahagiannya telah ditetapkan seperti isteri mendapat 1/8 bahagian sekiranya mempunyai anak. Waris 'Asabah pula ialah waris yang berhak mewarisi dan bahagiannya merupakan baki daripada harta pusaka setelah menetapkan bahagian Waris Fardhu. Sebagai contoh: Anak lelaki mendapat baki harta setelah menetapkan bahagian suami si mati (1/4) dan ibu (1/6), maka anak lelaki mendapat baki harta pusaka (7/12).

In my own word, from my understanding, the one who is most eligble are the parents, spouse and children of the deceased. The rest of the relatives i.e grandparents, uncle, aunty and sibling of the deceased are also eligible to receive the wealth in certain cases. ( i wonder what cases)

2 types of waris..Fardh and Asabah
Fard is the one who receive his/her part from the whole sum of the wealth i.e wife  with children is allocated 1/8 from the sum of the wealth.( this is based from the allocation mention in quran)

Asabah are the one who will receive his/her part based on the deducted amount of wealth already allocated for the Fardh waris.i.e if the deceased is a female mother leaving a husband,a child and a mother. So the husband will get ¼ and her mother will get 1/6 from her whole sum of wealth and her son will get 7/12 from the balance. The formula is

1 – (1/4 + 1/6) = 7/12

Of course this website did not explain in detail of the overall faraid system..but I guess if this is the introduction. then I’m beginning to understand where and how to go from here. More reading needed  inshaAllah.

Terdapat 15 ahli waris dari pihak lelaki dan 10 ahli waris dari dari pihak perempuan yang utama dan layak menerima harta pusaka.Waris dari pihak lelaki seperti berikut:
 1.  Anak lelaki
 2.  Cucu lelaki dari anak lelaki
 3.  Bapa
 4.  Datuk
 5.  Saudara lelaki seibu sebapa
 6.  Saudara lelaki sebapa
 7.  Saudara lelaki seibu
 8.  Anak saudara lelaki dari seibu sebapa
 9.  Anak saudara lelaki dari seibu atau sebapa
10. Bapa saudara seibu sebapa
11. Bapa saudara sebapa
12. Sepupu dari bapa saudara seibu sebapa
13. Sepupu dari bapa saudara sebapa
14. Suami
15. Hamba sahaya
Jika kesemua waris lelaki di atas wujud, maka hanya tiga orang sahaja yang layak iaitu:
1.  Bapa
2.  Anak lelaki
3.  Suami
Ahli-ahli waris perempuan yang layak menerima harta pusaka iaitu:
 1.  Anak perempuan
 2.  Cucu perempuan dari anak lelaki
 3.  Ibu
 4.  Nenek sebelah ibu
 5.  Nenek sebelah bapa
 6.  Saudara perempuan seibu sebapa
 7.  Saudara perempuan seibu
 8.  Saudara perempuan sebapa
 9.  Isteri
10. Petuan perempuan bagi hamba sahaya
Jika kesemua ahli waris diatas wujud, hanya 5 orang yang layak:
1.  Anak perempuan
2.  Cucu perempuan dari anak lelaki
3.  Ibu
4.  Saudara perempuan seibu sebapa
5.  Isteri




Jika kesemua 25 waris lelaki dan perempuan masih hidup, maka keutamaan akan diberikan kepada hanya lima ahli waris berikut:

1. Bapa - father
2. Ibu - mother
3. Anak Lelaki - son
4. Anak Perempuan - daughter
5. Suami/Isteri - spouse

Yesterday Once More

Assalamualaikum.....

These past few days i have been feeling sort of in DejaVu days. Always thinking many good memories i had had for the past 5-10 yrs ago. Sometimes you just wish you can go back to all those wonderful memories.

I guess all this reminiscent is base on the fact that i feel i'm no longer as energetic as before. How you wish you will always be the young, energetic and always on the go person. Anway..its true as that of the Prophet PBUH saying 'Grab the first 5 before came the other 5. One of them is to make the most of your youth before old age. I do not regret my youth days as i believe i have achieved so much indeed.

I remeber being one of the energetic leturer in the department, my schedule of travel/work within that 1-2 months of semester break is,  the Academic brain storming session of the university in Pangkor Island Beach,Resort (island retreat)  then practical  work  2 weeks onboard the Royal Malaysian Navy Ship cruising along the  Malacca Strait and then research work in Mulu National Park. Before that i was in Kota Kinabalu Sabah also sent by the Faculty for what a student reach out programme.I shall say this was the best year in my carrier life in the university. Not forgetting the adventerous jungle trekking with students in Berinchang Mountain in Cameron Highland. My first ever student counselor session. Then of course the student activity with my fellow lecturer, husband and wife and their small kid somehwere in Kelantan/ Thailand border. Anway i suddenly feel that i need to put those memories in this blog for my own pleasure. I do not have all the pictures associated with this memories as its back there in Malaysia, so im using google image to search for them and posting the pictures which resembles from the memories i have.

I'll start with Mulu National Park as i just can't seems to forget this beautiful scenery at the place called camp5. River sight by the mountain..wow...one of the picture below really resembles what i had back then. I love the hotel where we stayed most of the time. Mulu National Resort and i really  really wish that if we were given the rizk and opportunity by Allah, i would like to bring my husband and children there. Maybe not now as the children are still small and we are talking about 'venturing into the jungle' but Allah knows best. I do hope my family can experience what i had experienced there.

Have little memory of this but yes, we slept on this..but its much better then the logging camp. I remember this is where the mosquito repellents are very much needed.

Again these are not my pictures, i googled them and i do not know who those people in the pictures, but they were standing at places where i had taken the shot myself 5-7 years ago.The room in the Royal Mulu Hotel was superb and i shared it with a new friend of mine whom i forgot her name :( Whatever her name was,  memories trekking and the journey in Mulu National park with her will always be in my mind. May Allah makes us meet again.The team includes so many experts from many different areas makes it really a wonderful journey.

As i googled i also found pictures of the twin otter plane..which by itself was a great experience.Also the airplane view of the borneo jungle i saw



The last but not least are the pictures of the jungle trek i once ventured. Its the reason of this entry, about how i believe these track was the most enduring path in the journey and yet i completed it with much success and victory. i cant remember how long was the treakking part... maybe 2-6 hours...but i can assure you, the beg we shouldered all the way was 10-15kg or more...not forgetting the leaches that keep sticking to you all the way.... Alhamdulillah the victory was rewarding and the memories were priceless.







Not forgetting the item that makes the park attarctive to many visitors... the cave and the bats..and the guano..and also nenphantis and pinnacles.I just hope the park is being conserve carefully by the state government because one of our objective being there is to see the matter of conservation of the park.
